The court has clarified that there is no law that prevents women from living with a married man. The court made this remark during the hearing of a habeas corpus petition. The court said that if a woman marries an already married man, then in this situation, only the first wife can file a case of bigamy. The High Court has stated that it will not intervene in matters of morality.
According to media reports, the court said this while hearing a habeas corpus petition filed for the custody of a woman above 18 years of age. In the petition, the woman was accused of not living with her parents and going to live with a married man. The lawyer has said that the man with whom the woman went to live has ended all relations with his first wife. Additionally, the man has requested a divorce from his wife.
Court decision
According to reports, while giving its verdict on August 18, the court said that the woman is an adult and she has the full right to decide with whom she wants to live. The woman can live with a married man or a bachelor of her own choice; it is her personal decision. The court clarified that it will not interfere in matters of morality.
High Court direction
The High Court directed that since the woman does not want to live with her parents, the police should first take an undertaking from her as per her wish and then release her. In this undertaking, the woman will have to accept in writing that she wants to live with this person of her own free will. Also, the person with whom she is living will have to accept in writing that he wants to live with the woman.
