Allahabad High Court refused to grant bail to the accused who posted objectionable posts against PM Modi and the Indian Army. The court said that it is unacceptable to abuse the freedom of expression to insult high-ranking persons and spread communal hatred. The accused is accused of posting false and inflammatory videos against the Prime Minister and the Army.
Allahabad High Court has refused to grant bail to a person accused of posting objectionable content on social media against Prime Minister Narendra Modi and the Army. Single Bench of Justice Arun Kumar Singh Deswal said that freedom of speech and expression guaranteed under the Constitution is not limited to such acts which insult high dignitaries and create animosity among citizens.
Justice Deswal said that it has become a "fashion among certain groups of people" to misuse social media under the guise of freedom of expression by making baseless allegations against highly respected personalities and posting content that creates animosity and hatred among people.
What did the Allahabad High Court say?
The court said that our Constitution gives every citizen the right to freedom of expression, but this freedom does not allow a person to post disrespectful videos and other posts against the Prime Minister, the Indian Army and its officers, which on the one hand creates animosity among the people of India and on the other hand promotes separatism. It attempts to endanger the sovereignty, unity and integrity of India.
Objectionable posts were made against PM Modi and Army
According to the facts related to the case, a case has been registered against the accused Ashraf Khan alias Nisrat under Section 152 and 197 BNS in Sansi police station of Hathras. It is alleged that recently he uploaded edited videos on his Facebook page during the India-Pakistan military confrontation. According to the prosecution, the accused posted such content which showed the Prime Minister walking next to a donkey, which was driving a vehicle with an aircraft and after that he was also shown apologizing to Pakistan.
The post further showed Wing Commander Vyomika Singh sitting with the Pakistan Army Chief. The post also mentioned that the Prime Minister was running to save himself from a Pakistani missile. In another post, the accused wrote Pakistan Air Force Zindabad and showed an Indian aircraft being destroyed by a Pakistani aircraft.
Some other 'objectionable' posts were also posted against Defence Minister Rajnath Singh and Prime Minister Modi. The defence said that the objectionable posts were not forwarded. The state argued that the posts create animosity and show disrespect towards the Indian Army and the Indian Air Force.
